USPTO Rules In Miller Mendel’s Favor In Guardian Alliance Technologies’ Attempt to Invalidate MMI’s Patent

Seattle, WA. Miller Mendel, Inc. today received notice that the United States Patent and Trademark Office Patent Trial and Appeal Board (“PTAB”) rejected Guardian Alliance Technologies’ challenge against Miller Mendel’s eSOPH patent. BACKGROUND

In October 2018, attorneys for Miller Mendel filed a lawsuit againt the City of Oklahoma City contending the Police Department’s use of the Guardian Alliance Technologies software infringed Miller Mendel’s patent. The lawsuit was filed in Oklahoma (federal) Western District Court, case number 5:18-cv-00990.

In October 2019, reacting to Miller Mendel’s patent infringement lawsuit, Guardian Alliance Technologies filed a petition for “Inter Partes Review” (or “IPR”) of Miller Mendel’s Patent at the United States Patent and Trademark Office. The Patent Trial and Appeals Board reviewed Guardian Alliance Technologies’ petition and sided with Miller Mendel.

Miller Mendel has invested hundreds of thousands of dollars in research and development of its eSOPH system. Miller Mendel has an obligation to protect its intellectual property and its clients’ investments and interest in the eSOPH software platform. Miller Mendel will continue its prosecution of infringers to the fullest extent of the law.
